A hospital and upstairs gym will duke it out in court over a neighbourly noise complaint.

Perth Day Hospital in Osborne Park is suing Fitness Cartel, claiming its loud music and the sound of falling or dropped weights is putting patients at risk.

A doctor from the specialist facility on Scarborough Beach Rd in the city’s northern suburbs told the court that the vibrations from its upstairs neighbours were distressing for patients and felt like “bombs being dropped”. 

The Supreme Court has already dealt the gym an early blow.

Loud music and weight training is now temporarily banned between 6.30am and 8pm Monday to Friday. 

Fitness Cartel tried to argue the restrictions would result in about $14,500 in lost revenue every day.

The judge acknowledged the financial hit but ultimately decided the business can still operate.

“This has been disruptive for our members but we have informed them over the entire process,” Fitness Cartel WA director Matt Theng said.

“We appreciate them being very patient through this entire ordeal.”

Over the next three days the judge will hear from structural engineers and experts before deciding whether the gym can stay open 24-7, or continue as after hours only.

“We have built such a good community around this entire area and we’re very proud of all we built so far,” Theng said.
